These terms of service (“Agreement”) constitute a legally binding agreement between you (“Client”) and Success In Media, Inc. (“Success In Media,” “we,” “us,” or “our”) regarding the use of our media training, presentation training, communication training, and public relations consulting services (collectively, the “Services”). If you have entered into a customized program with us, you have received a separate customized agreement which prevails over this Agreement.
Payment: Client agrees to pay for the Services according to the payment terms set forth in the customized program agreement or the invoice. Payment is due upon receipt of invoice. We accept payment via credit card, PayPal, Venmo, ACH transfer or check. If payment is not received within 30 days of the invoice date, a late fee of 1.5% per month may be added to the total amount due.
Cancellation and Refunds: Many programs come with a 30 day refund guarantee. Your agreement will supersede this document. Client must provide written request to Success In Media. If you are in the Media Ambassadors program, refer to the document you agreed to at time of first payment. Refunds will not be given after 30 days.
Confidentiality: Success In Media agrees to keep all information provided by the Client confidential and will not disclose it to any third party without the Client’s express written consent.
Copyright: All materials provided to Success In Media by the Client for use in the Services provided will remain the property of the Client. Success In Media will not use any of these materials for any other purpose without the Client’s express written consent.
Disclaimer of Warranties: Success In Media provides the Services “as is” and makes no warranties, express or implied, with respect to the Services provided, including but not limited to any warranty of merchantability or fitness for a particular purpose.
Limitation of Liability: In no event shall Success In Media be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the Services provided.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of New York, without giving effect to any principles of conflicts of law.
Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this Agreement. If you signed another agreement or did so by paying and moving forward with services, that agreement would supersede this document.
